Ohio Supreme Court Rules Unanimously in Favor of Ohio Voters on Health Care Freedom Amendment
 
Columbus, Ohio, April 30, 2010
The Ohio Supreme Court ruled yesterday that Secretary of State Jennifer Brunner and the Ohio Ballot Board abused their discretion when they blocked a citizens’ initiative petition to offer a single amendment to the Ohio Constitution “to preserve the freedom of Ohioans to choose their health care and health care coverage.”
 
In a unanimous decision this Thursday the Court ordered Brunner and the Ballot Board to  certify the petition as drafted.  This order  allowed the Ohio Liberty Council and The Ohio Project to proceed with gathering the signatures needed to place the Constitutional amendment on the November ballot.
 
 
 
Thursday’s Supreme Court ruling held that the Ballot Board chaired by Secretary of State Brunner “abused its discretion and clearly disregarded applicable law.” The Court further found that the Ohio Liberty Council and The Ohio Project are entitled to a writ of mandamus ordering the Ballot Board to “immediately” certify to the Attorney General that The Ohio Project amendment “as drafted” is properly presented in a single petition.
 
Following the Supreme Court’s decision, the Ohio Liberty Council and The Ohio Project announced that thousands of volunteers throughout the state will begin “within days” to offer Ohio citizens the opportunity to sign the petition to place the proposal on the ballot in November.  This amendment to the Ohio Constitution would preserve the right of Ohioans to choose their own health care.
